Electronic signatures for tenancy agreements — the legal position
The electronic signature is governed in the EU by the eIDAS Regulation (Regulation No 910/2014). It distinguishes three levels: the simple electronic signature (EES), the advanced (FES) and the qualified (QES). A residential tenancy agreement is in principle subject to freedom of form — it can be concluded orally, in writing or electronically. A simple electronic signature is therefore sufficient in the vast majority of cases.
The important exception is the written form for fixed terms exceeding one year: under Common law (German Civil Code), a tenancy agreement with a term of more than one year must be concluded in writing, otherwise it is deemed to have been concluded for an indefinite period. Here the simple electronic signature cannot replace the statutory written form — that would require a qualified electronic signature (QES) or the classic paper form. This is precisely why Rentprime deliberately keeps both options open: print and digital signature.
For digital signatures, Rentprime documents an audit trail: timestamp, IP address and a log of the signing process. This evidence considerably increases the evidential value in the event of a dispute, even with a simple electronic signature. The finished, signed PDF is then archived in compliance with HMRC and in an audit-proof manner — unalterable and retrievable at any time.
